§2 Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen gelten für alle Bestellungen von Waren über den Online-Shop der GIOMECCA GmbH durch Verbraucher und Unternehmer.
Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können.
§3 Vertragsabschluss
Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot dar, sondern eine Aufforderung zur Bestellung.
Mit Anklicken des Buttons „Jetzt kaufen“ gibt der Kunde ein verbindliches Angebot zum Kauf der im Warenkorb befindlichen Produkte ab.
Der Vertrag kommt erst mit der Bestätigung der Bestellung per E-Mail oder der Bereitstellung der Ware zur Abholung zustande.
§4 Preise und Zahlung
Alle Preise verstehen sich inklusive der gesetzlichen Mehrwertsteuer, sofern nicht anders angegeben.
Folgende Zahlungsmethoden werden akzeptiert:
• Kreditkarte
• PayPal
• Weitere im Checkout angezeigte Zahlungsmethoden
Die Zahlung ist unmittelbar mit Abschluss der Bestellung fällig.
§5 Abholung und Lieferung
Die Abholung erfolgt zum bei der Bestellung ausgewählten Termin.
Der Kunde ist verpflichtet, die Ware innerhalb des angegebenen Zeitfensters abzuholen.
Bei verspäteter Abholung übernimmt GIOMECCA keine Haftung für Qualitätsverluste, die durch die Lagerung nach dem vereinbarten Abholzeitpunkt entstehen.
Soweit Versand angeboten wird, erfolgt dieser an die vom Kunden angegebene Lieferadresse.
§6 Verderbliche Waren und Widerrufsrecht
Verbrauchern steht grundsätzlich ein gesetzliches Widerrufsrecht zu.
Gemäß § 312g Abs. 2 Nr. 2 BGB besteht jedoch kein Widerrufsrecht bei Verträgen zur Lieferung von Waren, die schnell verderben können oder deren Verfallsdatum schnell überschritten würde.
Die von GIOMECCA angebotenen Produkte, insbesondere Torten, Monoporzionen, Gebäck, Eisprodukte und sonstige frische Konditoreiwaren, werden frisch hergestellt und verfügen über eine begrenzte Haltbarkeit.
Daher besteht für diese Produkte kein gesetzliches Widerrufsrecht.
Eine Stornierung ist nur bis zum Beginn der Produktion möglich. Nach Produktionsbeginn oder Bereitstellung zur Abholung ist eine Stornierung ausgeschlossen.
§7 Gewährleistung
Es gelten die gesetzlichen Gewährleistungsrechte.
Sollte ein Produkt mangelhaft sein oder während des Transports beschädigt worden sein, ist dies innerhalb von 24 Stunden nach Erhalt unter info@giomecca.com zu melden.
GIOMECCA wird den Einzelfall prüfen und nach eigenem Ermessen Ersatz, Gutschrift oder Rückerstattung anbieten.
§8 Haftung
GIOMECCA haftet unbeschränkt für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit.
Für sonstige Schäden haftet GIOMECCA nur bei Vorsatz oder grober Fahrlässigkeit sowie bei Verletzung wesentlicher Vertragspflichten.

§10 Schlussbestimmungen
Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts.
Sollten einzelne Bestimmungen dieser AGB ganz oder teilweise unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

§2 Scope of Application
These Terms & Conditions apply to all orders placed through the online shop of GIOMECCA GmbH by consumers and business customers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
§3 Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
By clicking the “Buy Now” button, the customer submits a binding offer to purchase the products contained in the shopping cart.
The contract is concluded only upon confirmation of the order by email or upon making the goods available for collection.
§4 Prices and Payment
All prices include the applicable statutory VAT unless otherwise stated.
The following payment methods may be accepted:
• Credit Card
• PayPal
• Other payment methods displayed during checkout
Payment is due immediately upon completion of the order.
§5 Collection and Delivery
Collection takes place at the date and time selected during the ordering process.
Customers are responsible for collecting their order within the agreed collection window.
GIOMECCA accepts no responsibility for any loss of quality resulting from delayed collection after the agreed pickup time.
Where shipping is offered, delivery will be made to the address provided by the customer.
§6 Perishable Goods and Right of Withdrawal
Consumers generally have a statutory right of withdrawal.
However, pursuant to Section 312g (2) No. 2 of the German Civil Code (BGB), no right of withdrawal exists for contracts involving goods that are liable to deteriorate rapidly or whose expiration date would quickly be exceeded.
The products offered by GIOMECCA, including cakes, pastries, individual desserts, ice cream products and other freshly made confectionery items, are freshly produced and have a limited shelf life.
Therefore, no statutory right of withdrawal applies to these products.
Order cancellations are only possible before production has started. Once production has begun or the products have been made available for collection, cancellation is no longer possible.
§7 Warranty and Complaints
The statutory warranty rights remain unaffected.
If a product is defective or has been damaged during transport, customers must notify GIOMECCA within 24 hours of receipt by email at info@giomecca.com.
GIOMECCA will review the case and may, at its sole discretion, offer a replacement, store credit, or refund.
§8 Liability
GIOMECCA shall be liable without limitation for damages resulting from injury to life, body, or health.
For all other damages, GIOMECCA shall only be liable in cases of intentional misconduct, gross negligence, or breach of essential contractual obligations.
§9 Privacy
Information regarding the processing of personal data can be found in our Privacy Policy available on www.giomecca.com.
§10 Final Provisions
These Terms & Conditions shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Should any provision of these Terms & Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
In case of discrepancies between the English and German versions of these Terms & Conditions, the German version shall prevail.
